1. General Provisions
1.1 Scope and Description of Services
1.1.1 The sole proprietor Alexander Hähnel, Hoherlehmer Straße 51, 15711 Königs Wusterhausen, Germany (hereinafter referred to as the “Provider”), operates an online platform under the brand name “Therapy with AI” (German: „Therapie mit KI“) (hereinafter referred to as the “Platform”).
1.1.2 Important Notice: The Platform does not provide medical, psychotherapeutic, or any form of licensed healthcare advice or treatment. The term “Therapy” in the name of the Platform refers exclusively to AI-assisted self-help aimed at promoting general well-being and must not be interpreted as a medical or psychotherapeutic service. Use of the Platform cannot and does not replace professional therapy or medical care. The term „therapy“ is used in a non-medical context and does not refer to treatment under the German Heilpraktikergesetz (Law on Non-Medical Practitioners) or the German licensing regulations for physicians (Approbationsordnung).
1.1.3 Use of the Platform requires the user’s acknowledgment and acceptance of these Terms and Conditions as well as the separate Privacy Policy. The current version of the Privacy Policy can be accessed here: Privacy Policy.
1.1.4 Deviating or supplementary terms and conditions provided by the user shall not apply unless the Provider has expressly agreed to them in writing.
1.1.5 The most current version of the Terms and Conditions is available on the Platform.
1.2 Consumer Status and Contract Language
1.2.1 The Platform is intended exclusively for consumers as defined in Section 13 of the German Civil Code (BGB).
1.2.2 The contractual language is German.
1.2.3 The contract text is not stored permanently. Users are therefore advised to save a copy of these Terms and Conditions for their own records.
2. Registration and Conditions of Use
2.1 General
2.1.1 Use of the Platform requires registration with a valid email address and a first name.
2.1.2 The Platform may only be used by individuals who are 18 years of age or older. Use by minors is strictly prohibited.
2.1.3 Each user may create only one account. Multiple registrations or intentional circumvention of access restrictions are not permitted.
2.1.4 All user-provided information must be complete and truthful. Any changes must be updated promptly in the user account.
2.1.5 The Provider reserves the right to restrict, suspend, or delete user accounts if false or misleading information has been provided, or if these Terms and Conditions have been violated.
2.2 Personal Access / Responsibility for Login Credentials
2.2.1 Access to the user account is strictly personal. Passwords must be kept confidential and must not be shared with third parties.
2.2.2 Any misuse of the account or unauthorized use by third parties must be reported to the Provider without delay.
2.2.3 The user is liable for all activities carried out using their customer account.
3. Usage Options and Pricing
3.1 Free Use (“Free Model”)
3.1.1 Users may access the Platform free of charge for a maximum of 10 minutes per day.
3.1.2 After the 10-minute limit is reached, the session will be terminated automatically.
3.1.3 If no paid usage or registration via email entry occurs, the entire conversation will be irreversibly deleted.
3.2 Paid Subscriptions
3.2.1 The Provider offers various subscription plans with additional features:
Basic (€49.99/month): Unlimited chat usage, access to mood images
Pro (€99.99/month): Unlimited chat usage, access to mood images, AI audio input and output
3.2.2 The minimum subscription period is one month. Subscriptions renew automatically for another month unless canceled.
3.2.3 Subscriptions can be canceled at any time via the Platform by clicking the relevant button under the „Receipts“ menu item. Upon cancellation, access to the additional features is immediately revoked. Users are explicitly notified of this within the Platform.
3.2.4 Payment Processing:
Payments are processed exclusively via Stripe, which offers various payment methods.
3.3 Data Storage
3.3.1 If a user is not registered, usage data and submitted messages are stored for 24 hours and then automatically deleted.
3.3.2 If a user is registered, all usage data and messages are stored until the user requests deletion of their account.
3.3.3 Upon a user’s request for account deletion, all associated data—including chat histories and messages—will be deleted.
3.3.4 Users are responsible for ensuring that no confidential personal data is transmitted to the Platform.
3.3.5 By using the Platform, the user consents to the analysis of submitted data for the purposes of quality assurance, usage analysis, and further development of the Platform by the Provider, and grants the necessary usage rights to the Provider for this purpose.
3.4 Platform Availability
3.4.1 The Provider makes every effort to ensure high availability of the Platform. However, due to technical reasons, 100% availability cannot be guaranteed.
3.4.2 The Provider reserves the right to temporarily disable the Platform for the purpose of carrying out updates and maintenance. Such downtimes may occur between 4:00 a.m. and 6:00 a.m. CET and will not be separately announced. Platform usage may be limited during this period.
4. Conclusion of Contract and Right of Withdrawal
4.1 Conclusion of Contract
4.1.1 By registering and using the Platform, a free user relationship is established.
4.1.2 By subscribing to a paid plan, a binding contract is concluded between the user and the Provider.
4.2 Right of Withdrawal
4.2.1 No right of withdrawal pursuant to Section 356(5) of the German Civil Code (BGB):
Since the Platform provides a digital service with immediate availability, the statutory 14-day right of withdrawal expires once the user expressly agrees that the service will begin immediately.
4.2.2 Before completing a subscription, the user must confirm—by ticking a separate checkbox—that they waive their right of withdrawal.
5. Liability and Disclaimer
5.1 Not a Substitute for Professional Psychological or Medical Assistance
5.1.1 The Platform is solely intended for self-help purposes and does not constitute medical or psychotherapeutic advice, diagnosis, or treatment.
5.1.2 The responses generated by the AI are based on algorithmic processes and have not been reviewed by psychologists or medical professionals.
5.1.3 Use of the Platform is at the user’s own risk. Users experiencing severe psychological conditions or crises should consult a qualified professional.
5.1.4 In acute emergencies, professional help services must be contacted. Emergency numbers provided on the Platform are for informational purposes only and are not legally binding.
5.2 Limitation of Liability under German Law
5.2.1 The Provider is not liable for any damage resulting from the user’s disregard of explicit warnings.
5.2.2 The Provider is not liable for indirect damages, consequential damages, or data loss, unless such damages were caused intentionally or through gross negligence. In the case of slightly negligent breaches of essential contractual obligations, liability is limited to the typical, foreseeable damage.
5.2.3 The AI may generate incorrect, inappropriate, or inaccurate responses.
5.2.4 Users are obligated to report such content without delay.
6. Consumer Dispute Resolution
6.1 Competent Consumer Arbitration Body:

6.2 The Provider is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
7. Final Provisions
7.1 These Terms and Conditions are governed by the laws of the Federal Republic of Germany.
7.2 If any clause of these Terms and Conditions is found to be invalid, the remaining provisions shall remain unaffected.
7.3 The Provider reserves the right to amend these Terms and Conditions for valid reasons (e.g., legal changes, introduction of new features). Users will be informed in advance by email. If the user does not object within four weeks, the changes shall be deemed accepted.
